Terms of Service

These Terms of Service govern your access to and use of Evideva, the AI governance and documentation platform operated by Skillquanta (Pty) Ltd, a South African private company.

By accessing or using the Evideva platform, you agree to be bound by these Terms of Service. These terms are intended to be consistent with applicable South African law, including the Electronic Communications and Transactions Act, 2002 (ECTA), the Consumer Protection Act, 2008 (CPA), and international principles commonly applied to online services and data processing.

1. Parties and legal entity

Evideva is a product and service offered by Skillquanta (Pty) Ltd, a South African company. Skillquanta (Pty) Ltd is the legal entity responsible for the platform, its subscriptions, and related services.

2. Scope of service

Evideva provides AI governance, risk assessment, and document generation tools for organisations that need to prepare compliance documentation for the EU AI Act and related regulatory needs.

We reserve the right to modify, suspend, or discontinue features or services at any time where reasonably necessary to maintain security, compliance, or service quality, provided that we do not materially reduce the core functionality without reasonable notice.

3. Account and user responsibilities

You must provide accurate information when creating an account and remain responsible for the security of your credentials. You agree not to use the platform for unlawful, fraudulent, abusive, or harmful purposes.

Where you are acting on behalf of an organisation, you confirm that you have authority to bind that organisation to these terms and to provide any necessary consents.

4. Subscription, fees, and payments

Access to certain features may require a paid subscription or one-time purchase. Fees are billed as described at the point of purchase. You agree to pay all amounts due in accordance with the selected billing cycle.

Where applicable law gives you statutory rights to cancel or receive a refund, we will comply with those rights. Otherwise, fees are generally non-refundable once the relevant service period has commenced, except where a material failure by us prevents the service from being provided as described.

5. Intellectual property

All intellectual property rights in the Evideva platform, branding, software, documentation, templates, and content provided by us remain with Skillquanta (Pty) Ltd or our licensors. You may use the platform only for lawful internal business purposes within the scope of your subscription.

You retain ownership of any content, documents, and information you upload or create through the service, subject to our right to process such content solely to provide and improve the service in accordance with our Privacy Policy.

6. Acceptable use

You agree not to upload or transmit content that is unlawful, misleading, defamatory, infringing, obscene, or otherwise harmful. You must not attempt to reverse engineer, scrape, or circumvent the platform’s access controls.

7. Privacy and data protection

Your use of Evideva is also governed by our Privacy Policy. We process personal information in accordance with applicable South African law, including POPIA, as well as applicable international frameworks such as the GDPR where relevant.

8. Limitation of liability

To the maximum extent permitted by law, Skillquanta (Pty) Ltd will not be liable for indirect, incidental, special, or consequential damages, including loss of business, reputational harm, or loss of data, except where such exclusion is prohibited by law.

Our aggregate liability for any claim arising from the use of the service shall not exceed the fees paid for the relevant service, unless a higher liability is required by applicable law.

9. Governing law and dispute resolution

These terms are governed by the laws of the Republic of South Africa. Any dispute arising from these terms or the use of the service shall first be addressed in good faith through negotiation.

Where a dispute cannot be resolved amicably, it may be brought before the competent courts of South Africa.
